By installing and using Notch ("the app"), you agree to these Terms. If you don't agree, please don't use the app.

What the app is

Notch is a personal fitness planning tool. It reads from Apple Health and Apple Calendar (with your permission), helps you plan a weekly workout schedule, and provides general guidance about training load and recovery based on your data.

Not medical advice

Notch is not a medical device and does not provide medical advice. The Freshness score, training load, workout suggestions, and any coaching are informational only. They are not intended to diagnose, treat, cure, or prevent any condition, and they don't replace the judgment of a qualified healthcare professional.

Talk to your physician before starting, changing, or intensifying any exercise program — especially if you are pregnant, have a heart, lung, joint, or metabolic condition, are recovering from an injury or illness, or have any other reason to be uncertain about your fitness for exercise.

Listen to your body. If a workout the app suggests feels wrong, if you experience chest pain, dizziness, shortness of breath, joint pain, or any other warning sign, stop and seek professional help. The plan is a suggestion, not an instruction. You are always the final judge of what to do on any given day.

Eligibility

You must be at least 13 years old (or the digital-consent age in your jurisdiction) to use the app. If you're under 18, please use the app with a parent or guardian's involvement.

License

We grant you a personal, non-exclusive, non-transferable license to install and use the app on your Apple devices for your own personal use, subject to these Terms and Apple's App Store Terms of Service.

Your responsibilities

You're responsible for the accuracy of the information you enter, for the permissions you grant, and for your own judgment about training and recovery. Workouts the app proposes are suggestions — you decide whether to actually do them.

Apple Health and Calendar data

The app reads and writes data through Apple's HealthKit and EventKit frameworks with your permission. You can revoke either permission at any time from iOS Settings. The app cannot access this data without your explicit consent.

Third-party services

The app integrates only with Apple's first-party frameworks (HealthKit, EventKit, CloudKit, UserNotifications). It does not include third-party analytics, advertising, or tracking SDKs.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the app will be error-free, uninterrupted, or that its results will be accurate or reliable.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions don't allow these exclusions; in those, our liability is limited to the maximum extent permitted by law.

Changes to these Terms

We may update these Terms occasionally. The effective date at the top will change and material updates will be surfaced in-app.

Termination

You may stop using the app at any time. We may withdraw or update the app at any time.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles.
